OVERVIEW

Welcome to EttaGallery (“we”, “us”, “our”). EttaGallery operates this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Our store is powered by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy and Returns & Refunds Policy), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy at /policies/privacy-policy. If you do not agree, do not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your place of residence and you consent to use by any minor dependents on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant all information is accurate, current, and complete and that you have rights to provide it. You are responsible for safeguarding your credentials and all activity under your account. You may not transfer or sell your account.

SECTION 2 – OUR PRODUCTS

We strive to display products accurately, but colors/appearance can vary by device and settings. We do not warrant that any product’s appearance or quality will meet your expectations. Product descriptions, availability, and pricing may change at any time without notice. We may discontinue products and limit quantities for any person, region, or jurisdiction.

SECTION 3 – ORDERS

Your order is an offer to purchase. We may accept or decline any order at our discretion. An order is accepted only when we confirm acceptance and process your payment. Please review carefully before submitting; we may be unable to cancel after acceptance. If we do not accept, modify, or must cancel an order, we will attempt to notify you using the contact details you provided.

Your purchases are subject to our Returns & Refunds Policy: /policies/refund-policy.

EU/EEA & UK consumers: you have a 14-day statutory right to cancel distance contracts without reason (subject to legal exceptions). We will handle cancellations and refunds in line with applicable consumer law (see also our Returns & Refunds Policy).

Outside countries with a statutory return/cancellation right, we do not accept change-of-mind returns; if you need assistance, contact us within 14 days of delivery and we’ll review your case at our discretion (see policy).

You represent that purchases are for personal/household use and not for resale or export.

SECTION 4 – PRICES, TAXES, AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price at the time of order, shown in your confirmation email. Unless stated otherwise, posted prices exclude taxes, shipping/handling, customs, duties, and import charges. Promotions may be governed by separate terms that will prevail in case of conflict.

You agree to provide current, complete, and accurate purchase and payment information, and to promptly update it as needed. You represent and warrant that you are authorized to use the payment method and will pay all charges including applicable taxes and fees.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss transfer to you when we hand orders to the carrier. You are responsible for any customs duties, taxes, or import fees.

SECTION 6 – INTELLECTUAL PROPERTY

All content in the Services (including trademarks, text, images, graphics, video, audio, and their arrangement) is owned by EttaGallery, its affiliates, or licensors and protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only. No rights or licenses are granted except as expressly set out in these Terms. EttaGallery names/logos are our trademarks; Shopify’s names/logos are Shopify’s trademarks; other marks belong to their owners. Any unauthorized use may violate IP laws.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements and without liability for your use. Your use is at your own risk and subject to the third party’s terms. New features may be added and will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may link to third-party sites or include third-party materials. We do not control, endorse, or assume responsibility for them. Access is at your own risk. Review third-party terms and policies before engaging in any transaction or using their services.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

EttaGallery is powered by Shopify, enabling us to provide the Services. Sales are made directly by EttaGallery. Shopify is not responsible for sales between you and EttaGallery or for any injury, damage, or loss resulting from purchased products/services. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from your transactions with EttaGallery.

SECTION 10 – PRIVACY POLICY

Your personal information is handled per our Privacy Policy at /policies/privacy-policy and, for platform-level processing, Shopify’s privacy policy (see Shopify’s Consumer Privacy Policy and Privacy Portal/Controls). Because the Services are hosted by Shopify, data you submit may be processed by Shopify and service providers in countries other than yours. See our Privacy Policy for details and your rights.

SECTION 11 – FEEDBACK (REVIEWS, IDEAS, SUGGESTIONS)

By submitting any ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display the Feedback for any purpose. You warrant you have necessary rights; that you disclose any incentives; and that your Feedback complies with these Terms. We may, but are not required to, monitor, edit, or remove Feedback. You are solely responsible for your Feedback.

SECTION 12 – ERRORS, INACCURACIES, OMISSIONS

Information on the Services may contain errors or omissions (e.g., descriptions, pricing, shipping charges, transit times, availability). We may correct or update and cancel orders affected by errors at any time without prior notice (including after you submit an order).

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to, among other things: violate laws; infringe IP rights; harass or harm others; transmit misleading information; send spam; upload malware; scrape or collect others’ data without consent; interfere with security features; or otherwise engage in conduct that harms EttaGallery, Shopify, users, or the Services. We may suspend or terminate access for violations.

SECTION 14 – TERMINATION

We may terminate or suspend the Services (in whole or part) at any time in our discretion. You remain liable for amounts due up to the termination date. Sections intended to survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

Except as expressly stated by EttaGallery, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not guarantee uninterrupted, timely, secure, or error-free use. Your use is at your own risk. Some jurisdictions do not allow certain disclaimers; to that extent, these may not apply to you.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, EttaGallery and its officers, employees, agents, partners, contractors, service providers, and licensors (and Shopify and its affiliates) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits/revenue/data, arising from or related to the Services or products, even if advised of the possibility. Nothing in these Terms excludes or limits liability where such exclusion or limitation is unlawful (e.g., for death or personal injury caused by negligence, or for fraud).

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless EttaGallery, Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, violation of third-party rights, or misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision is unlawful, void, or unenforceable, the remainder will remain in full force, and the provision will be enforced to the maximum extent permitted.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

No waiver of any right is a continuing waiver unless stated in writing. These Terms, together with policies posted on the site, constitute the entire agreement between you and us regarding the Services and supersede prior agreements. Ambiguities will not be construed against the drafting party.

SECTION 20 – ASSIGNMENT

You may not assign or transfer these Terms or any rights/obligations without our prior written consent. We may assign or transfer these Terms without notice.

SECTION 21 – GOVERNING LAW AND JURISDICTION

These Terms and any separate agreements for the provision of the Services are governed by Italian law (without regard to conflict-of-law rules). You and EttaGallery submit to the exclusive jurisdiction of the courts of Milan, Italy.

Consumers in the EU/EEA or United Kingdom: Nothing in these Terms limits your mandatory consumer protectionsunder the laws of your habitual residence. You may bring proceedings relating to these Terms in the courts of your place of residence (EU/EEA/UK), and we will bring proceedings only in those courts or in your country of residence where required by applicable consumer law.

SECTION 23 – CHANGES TO THE TERMS

You can review the most current version of the Terms on this page. We may update these Terms by posting changes here. Where required by law, we will notify you of material changes and specify the effective date. Your continued use after changes take effect constitutes acceptance.
